Justice Ijazul Ahsan's Recusal Sought in Supreme Judicial Council Proceedings Against Justice Naqvi
A petition has been filed in the Supreme Court seeking Justice Ijazul Ahsan's recusal from the Supreme Judicial Council's (SJC) proceedings against Justice Mazahir Naqvi. The petition argues that Justice Ahsan's participation in the proceedings violates the principles of natural justice and fair trial.
The petition was filed by Mian Dawood, one of the complainants against Justice Naqvi. Dawood argues that Justice Ahsan's participation in the proceedings is biased because he had dissented with the majority decision to issue a show-cause notice to Justice Naqvi.
Dawood also argues that Justice Ahsan's participation in the proceedings could create an appearance of bias among the public. He argues that the SJC is a high court and that its members are held to the highest standards of impartiality.
The petition requests that the Supreme Court declare that Justice Ahsan's participation in the proceedings is in violation of Articles 9 and 10-A of the Constitution of Pakistan. The petition also requests that the court declare that the judge next most senior in rank replace Justice Ahsan as a member of the SJC for the purpose of deciding the complaints against Justice Naqvi.
The Supreme Court has not yet scheduled a hearing on the petition.
